Please read carefully these terms of sale before placing your order. All orders for goods accepted by Creaclic.ch are accepted subject to the following conditions which shall form part and govern the contract of sale. Acceptance of goods shall be deemed to be acceptance of these conditions of sale.
Orders
Inclusion on Creaclic's Price list does not mean goods are in stock. Creaclic.ch endeavours to comply with the date named for dispatch or delivery. The date is given and intended as estimate only and is not to be the essence of the contract. If owing to non-availability of goods or any other causes beyond Creaclic's control, Creaclic shall be unable to effect delivery, and accepts no liability. The customer will be informed immediately of non available goods. Non available goods will be refunded in full. Customers will be informed via email of dispatch of goods. If the customer is unable to accept delivery of goods, an alternative delivery date may be arranged or a full refund offered.
Description and price of the goods
The description and the price of the goods you order will be shown on Creaclic's current website at the time you place your order.
All drawings, descriptive matter, specifications contained on Creaclic's website are published or issued for the sole purpose of giving an approximate idea of the goods described in them. They will not form part of this contract.
Every effort is made to ensure that prices shown on Creaclic's website are accurate at the time you place your order. If an error is discovered Creaclic will inform you as soon as possible and offer you the option to either reconfirm your order at the correct price or cancel it. If you choose to cancel, Creaclic will refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.
Delivery
The goods you order will be delivered to the address you specified in your account. If the goods are to be delivered to a different address, this must be specified at the time the order is placed and cannot be changed afterwards.
Creaclic endeavours to dispatch On-Line orders within 1-5 days. If items are temporarily out of stock and dispatch is anticipated to be after the five day period, the customer will be contacted by email or phone to agree on a new delivery date. If this date is unsuitable, a full refund will be offered.
Unless otherwise noted, all sales of goods are made f.o.b. point of shipment and, in all cases, title shall pass upon delivery to the carrier at point of shipment and thereafter all risk of loss or damage shall be upon Buyer.
Delivery out of Switzerland
Actual shipping times vary for each country and your local customs officials or postal authorities may delay deliveries. Note that your shipping costs could be in addition to any applicable taxes, customs and import duties (these costs vary by country).
Damages
Creaclic does not undertake any liability for damages caused by improper operations by the customer, by wrong use or inadequate storage of his products.
Cancellation
If for any reason you decide not to keep an item, you can return it for a refund or replacement. Non faulty items must be returned in their original packaging where appropriate and must be in an unused condition.
Once you have notified Creaclic that you are cancelling the contract, Creaclic will refund or re-credit you within 30 days for any sum that has been paid by you.
If the goods Creaclic will deliver to you are not as ordered or are damaged, defective or of incorrect quantity, Creaclic's liability shall be limited to replacing the damaged or defective products or if replacement goods are not available, Creaclic will issue a refund.
Creaclic shall not be liable for failure to deliver goods ordered by you unless notified within 60 days of the date of the original order. Creaclic's liability will be limited to delivering the goods ordered or refunding the price and delivery charges of the non-delivered goods.
Payment
Payment for the goods can be made by any method shown on Creaclic's website at the time you place your order.
Property and Risk
For so long as any amounts remain owing from the purchaser to Creaclic (whether immediately due or not) title to the property of the goods shall remain that of Creaclic and ownership will not pass to the purchaser until Creaclic has received payment in full.
Applicable law
As the internet allows access to the site from countries acting under different laws differing from those of Creaclic (anywhere outside Switzerland), you agree that insofar as is allowed by any relevant legislation or jurisdiction, Swiss Law shall govern this contract and any dispute under it.
